General
Sugar Rush Bakery is owned and operated by Hatch Productions Pty Ltd (ABN 99 497 604 238). By accessing or placing an order through our website, you agree to these Terms & Conditions.
We may update these Terms & Conditions from time to time. Any changes take effect immediately once published on our website.
Nothing in these Terms & Conditions excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (ACL) or Consumer Protection WA.
Government-Mandated Closures & Unforeseen Events
If Sugar Rush Bakery is unable to fulfil your order due to circumstances beyond our reasonable control (including government-mandated closures, natural disasters, power outages, or significant supply disruptions), you will be offered either:

A full refund, or

The option to move your order to a future date
The choice will be at the customer’s discretion.
Order Confirmation & Payment
Full payment is required to confirm all orders. Orders are not secured until payment has been received.
Once payment is made, your order is considered confirmed and preparation may begin immediately.
Changes to Orders
Requests to change delivery addresses, delivery dates, messages, or products must be submitted via email to hello@sugarrushbakery.com.au at least 48 hours prior to the scheduled delivery or collection date.
We cannot guarantee changes requested within 48 hours, as production and scheduling may already be underway.
Cancellations & Refunds

48 hours or more notice: Full refund to the original payment method

24–48 hours’ notice: Credit note issued, valid for 12 months

Less than 24 hours’ notice or on the day of delivery: No refunds or credits, as preparation will have commenced
Refunds, where applicable, may take 1–10 business days to appear in your account.
These cancellation terms apply unless otherwise required under the Australian Consumer Law.
Delivery
We deliver to the Perth metropolitan area and selected surrounding suburbs. Delivery availability is subject to distance and logistics.
Delivery windows:

Monday–Friday: 8:00 am – 5:00 pm

Saturday: 8:00 am – 6:00 pm
Delivery times are estimates only. While we make every reasonable effort to deliver within these windows, we cannot guarantee exact delivery times.
Delays caused by factors outside our reasonable control (including traffic or courier delays) do not automatically entitle customers to refunds under the ACL.
If Nobody Is Available to Accept Delivery
If no one is available to accept delivery, the order may be left at the delivery address at the driver’s discretion where it is safe to do so.
If it is not safe to leave perishable items due to extreme weather, the order will be returned to Sugar Rush Bakery and will be available for collection during our normal operating hours, unless otherwise agreed in writing prior to delivery. A re-delivery fee will apply if re-delivery is requested.
No refunds will be issued for attempted delivery. Once delivery has been attempted in accordance with the details provided, the order is considered fulfilled. It is the responsibility of the person placing the order to provide clear delivery instructions, including authority to leave where applicable.
Authority to Leave & Delivery Details
Customers are responsible for providing accurate and complete delivery information, including recipient details and a valid local Australian contact number.
If the driver cannot access the address or contact the recipient, the order may be returned to the bakery and a re-delivery fee may apply.
Deliveries to businesses or schools are made at the customer’s risk and may occur outside operating hours.
Cake Design & Handmade Nature
All cakes are handmade. Minor variations in colour, size, decoration, or finish are normal and do not constitute faults under the Australian Consumer Law.
We reserve the right to substitute flavours or decorations where necessary due to availability, while ensuring the product remains of acceptable quality.
Cake Storage & Handling
Cakes are best stored in a cool, dry place away from direct sunlight. Refrigeration may cause cakes to dry or harden.
If consuming the following day, refrigerate overnight in our packaging and allow the cake to return to room temperature for 5–6 hours before serving.
Sugar Rush Bakery is not responsible for damage caused after delivery due to handling, storage, or environmental conditions outside our control.
SMS Marketing
By providing your mobile number at checkout, subscribing online, or opting in in-store, you provide express consent to receive SMS communications from Sugar Rush Bakery.
Messages may include promotions, order updates, reminders, and relevant communications. Message frequency may vary.
You may opt out at any time by replying STOP to any message or contacting hello@sugarrushbakery.com.au.
Standard message and data rates may apply. Personal information is handled in accordance with our Privacy Policy. We comply with the Spam Act 2003 (Cth).
Consumer Guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Limitation of Liability
To the extent permitted by law, Sugar Rush Bakery’s liability for any claim relating to goods or services supplied is limited, at our option, to:

Replacement of the goods, or

Refund of the purchase price
We are not liable for indirect or consequential loss, except where required by law.
Governing Law
These Terms & Conditions are governed by the laws of Western Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
